Doula Services Terms and Conditions

These Terms and Conditions (the "Agreement") govern the services provided by Kels the Doula, a professional doula service provider, to the client (referred to as "Client," "You," or "Your") seeking pregnancy, birth, postpartum, and fertility doula services. By engaging with our services, You agree to be bound by these terms and conditions.
1. Services Provided
Kels the Doula offers the following services:
Prenatal Doula Support: Support and guidance during pregnancy, including emotional support, educational resources, and birth planning.
Birth Doula Support: Continuous labor support, including physical and mental comfort techniques, emotional encouragement, and advocacy during labor and delivery.
Postpartum Doula Support: Assistance with newborn care, breastfeeding support, postpartum recovery, and emotional support in the early weeks after childbirth.
Fertility Doula Support: Support and guidance during the trying to conceive phase or in virtro fertilization process, including emotional support, and educational recourses.
These services will be provided in accordance with the personalized needs of each client as discussed during initial consultations and intake forms.
2. Client Responsibilities
To ensure the best experience and outcome, you agree to the following responsibilities:
Communication: Provide accurate, up-to-date contact information and notify your doula of any significant changes in your pregnancy or health status.
Health Information: You agree to share any relevant medical information, birth preferences, and any specific concerns or requests.
Respect for Doula's Role: You understand that your doula is there to support you during labor but is not responsible for making medical decisions or replacing healthcare providers. Your doula will support your birthing plan but will not provide medical care, advice, or treatments.
3. Availability & Backup Doula
Availability: Your doula will be available to support you from pregnancy through delivery and the postpartum period (as agreed).
Backup Doula: Currently we do not have a network of available back-up doulas, in the event your doula is unavailable due to illness or emergency you will receive a 65% refund and extra postpartum services.
4. Fees and Payment
The fees for doula services are broken down as follows:
Prenatal Support Fee: $600
Labor and Birth Fee: $800
Postpartum Support Fee: $400
Fertility Support Fee: $600$
Payment schedules vary based on packages and are required as follows:
Classes:
Balance: Full payment is due at time of booking.
Hourly Contracts:
Balance: Full payment is due within 24 hours of completed services.
In Bloom Package:
Deposit: A deposit of 50% is due upon booking to reserve your doula services.
Balance: The remaining balance is due by week 36 of pregnancy.
Growing Flowers Package:
Deposit: A deposit of 50% is due upon booking to reserve your doula services.
Balance: The remaining balance is due by week 36 of pregnancy.
Nurturing Roots Package:
Balance: The full payment is due at the time of booking.
Planting the Seed Package:
Deposit: A deposit of 50% is due at the time of booking.
Balance: The remaining balance is due by month 5 of service.
Seed to Flower Package:
Deposit: A deposit of 25% is due upon booking to reserve your doula services.
Payments: Another 25% payment is due by week 15 of successful pregnancy. The remaining balance is due by week 36 of pregnancy
Payment Methods: Payments can be made via cash, email transfer or credit card.
Non-Refundable Deposit: The deposit is non-refundable, but it may be applied to rescheduled services or transferred to a new client in the event of cancellation, as described below.
5. Cancellation and Refund Policy
Client Cancellation: If the client cancels services before the start of labor, they will be refunded any payment minus the non-refundable deposit.
Doula Cancellation: In the event that the doula must cancel or reschedule services (not including birth support, see back-up doula) due to an emergency or personal conflict, the client will be offered a full refund of any payments made.
Rescheduling: If you need to reschedule a prenatal or postpartum visit, please notify the doula at least 24 hours in advance. If this policy is not followed, a rescheduling fee may apply.
6. Client Confidentiality
We respect your privacy and are committed to maintaining the confidentiality of your personal and medical information. All client information, including birth plans and health information, will be kept confidential, except as required by law or with your explicit consent.

7. Limitation of Liability
Medical Care: Doulas do not provide medical care or advice. In case of medical emergencies or complications, your healthcare provider will be contacted immediately.
Independence: Your doula is an independent contractor, not an employee of any medical facility. The doula’s role is to provide support, comfort, and guidance—not medical decisions or interventions.
Informed Consent: You acknowledge that while your doula will make every effort to provide exceptional support, labor and birth are unpredictable, and outcomes cannot be guaranteed. The doula will not be liable for any negative outcomes, complications, or injuries.
8. Birth Preferences
While your doula will respect and support your birth preferences, you acknowledge that unexpected circumstances may arise during labor and delivery that may require changes to your birth plan. Your doula will work to advocate for your preferences but will not be held liable if circumstances require deviations from your birth plan.
9. Dispute Resolution
In the event of a disagreement or dispute regarding the services provided, both parties agree to first attempt resolution through mediation. If mediation is unsuccessful, the matter will be resolved in a court of competent jurisdiction.
10. Changes to Terms and Conditions
Kels the Doula reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to you via email or other means of contact.
